The parties to this contract are:

“Shepherd’s Rest Campsite” also referred to as “we”, “us”, “our” etc., which is owned by Alison and Mark Hibbert, Lamins Farm, Foulden, Scottish Borders, TD15 1UH.

and

“You” or “your”, being the party or parties named on the booking receipt/summary, and each member of your group jointly and individually, whether family or not, and any day visitors that you may have.

Contract Acceptance
Upon booking a Shepherd’s hut, pitch or by using any camp facilities and car parking area, you agree to abide by the Camp Rules and these Terms and Conditions. The contract between Shepherd’s Rest and you exists once a booking has been made and/or you begin to use camp facilities.

Charges and Fees for Shepherd’s hut, pitches, optional extras
You agree to pay all charges and fees as set out at the time of booking, or when you add an optional extra to your booking.

Facilities and Services
We will provide you with the facilities and services indicated on our website and marketing media, subject to availability. For operational reasons, these may not always be exactly as portrayed, but will be similar. Certain services may be temporarily unavailable if weather conditions make it dangerous, e.g. fire pits in extremely dry weather causing a fire hazard.

Access to Shepherd’s huts or pitches
Most bookings will be fully paid at the time of booking, please bring your booking summary/receipt with you either in paper or email form. All customers must contact reception on arrival for instructions on accessing their accommodation or pitch.

Disclosure of Information
When booking through our website or by email/phone, you will disclose any and all details of every member of your party. This includes numbers of tents/pitches and size if over 7m for tents or 6m for campervans. We do not accept pets. Failure to declare all such information may result in additional charges or being denied entry.

Payment
Full payment is due at the time of booking your Shepherd’s hut or pitch. This may be made online using your credit or debit card (Visa or Mastercard) if you place your booking through our booking system operated by Free To Book or other OTA’s , over the phone using a credit/debit card or payment link (Sumup or Stripe) or by cash in person on arrival (only if it is an on-the-day, not pre-booked pitch). We reserve the right to temporarily hold an amount prior to arrival.

Once you have checked in, any charges for additional extras e.g. fire pit hire or supplies can be paid either in cash or card. In any event, any outstanding fees or charges must be paid in full before departure.

Shepherd’s huts security deposit
For Shepherd’s hut bookings, a deposit of £100 will be pre-authorised on your payment card on check-in day and held up to 3 days after departure. Any damage will be assessed and charged against the pre-authorisation up to £100. If damage value is likely to be more than £100 or valuation is taking longer, we will contact you separately. If there is no damage, the security deposit pre-authorisation will be cancelled with no charge made.

Cancellation Conditions

  • Any cancellation must be notified in writing or by email to be effective.
  • If the booking is cancelled 7 or more days before arrival then a charge equal to 50% of the stay will be made.
  • If the booking is cancelled less than 7 days before arrival then a charge equal to the full booking amount will be made, i.e. no refund.
  • In the event of a no show or booking reduction (after arrival date) the full cost of the booking will be charged, i.e. no refund.
  • Any amendments to bookings will be at the sole discretion of Shepherd’s Rest.

Exceptional Circumstances
Occasionally we may have to re-arrange or cancel your booking due to very extreme circumstances. In this event, we will contact you and offer alternative dates for your booking. If alternative dates are not acceptable to you, we will refund in full all charges/fees for your booking. However, if such re-arrangement or cancellation is necessary due to Force Mageure (e.g. fire, flood, earthquake, storm, hurricane or other natural disaster), war/hostilities, pandemic, interruption or failure of services (utilities, water, waste) and any events we cannot anticipate and which are beyond our control that may prevent or disrupt the performance of the contract, then we shall accept no liability, pay no compensation or refund nor meet any of your consequential expenses.

Payment for damage caused
We will seek financial compensation for damage to our, our neighbour’s or other client’s property caused by you either wilfully or through lack of due care and attention.

Non-compliance with site rules, terms & conditions
We have the right to make specific requests for compliance with the Camp Rules and this contract. If such compliance is not forthcoming, we reserve the right to instruct you and/or specific members of your party to leave the premises as soon as reasonably possible. We may arrange for your removal if we meet with continued refusal. Such action will not be taken unreasonably or without prior discussion with you.

Refusal of Entry
We reserve the right to refuse entry to the campsite and facilities to anyone who, in our judgement, may be at risk of non-compliance with the rules, terms and conditions. In such circumstances, no refunds will be given. Such action will not be taken unreasonably or without prior discussion with all parties.

Wider farm areas
Guests are permitted to walk round the wider farm area at their own risk, but should not go into electric fenced areas where there may be pigs and horses, without being accompanied by a member of staff. Make sure all gates remain closed. No feeding of any animals. We prefer that guests come round the farm accompanied, this gives a better experience for both guests and our animals.

Liability
Some activities and situations may be unfamiliar or new to you. We will provide advice when requested, however you confirm that by glamping or camping at Shepherd’s Rest and using shared facilities, you accept that all members of your group are undertaking outdoor activities in a natural environment in which all risk cannot be “managed out”. You agree to take responsibility for your own Health and Safety and that of your group jointly. You must ensure responsible and prudent behaviour at all times to prevent accidents and annoyance to other guests.

You accept that you will be using the facilities provided at your own risk. They are maintained in good working order and we will accept no liability for accidents or injuries howsoever caused.

You are responsible for your own property and possessions while on site, we will accept no liability whatsoever for any theft, loss or damage, insured or not.

Complaints & dissatisfaction
If you discover any issues with the facilities and services provided, or experience problems with other guests on site, please raise the matter with a member of staff, who will try to resolve the issue if possible. If the matter cannot be resolved by them, you must make a written complaint with 21 days of departure to enable us to investigate it fully. No complaint will be accepted if the first two steps have not been done first. If in our judgement the complaint is justified, we will offer such compensation or recompense as we believe appropriate. This does not affect your statutory rights.
